The bill would temporarily restrict the access to civil service jobs by high-level officials of the former Communist regime.</p>
<p>First declared unconstitutional in 2010, the law was revised in February 2012 at the request of the ruling Democrat-Liberal Party. The proposed bill was then approved by parliament.</p>
<p>&quot;Demanded insistantly by civil society, supported by politicians in election campaigns, the law now risks being buried for good,&quot; regrets <em>Rom&acirc;nia Liberă</em>. <item><title>Crime | Brussels to crack down on mob</title><link>http://www.presseurop.eu/en/content/news-brief/1617221-brussels-crack-down-mob</link><description><![CDATA[<p>On 12 March, the European Commission <a href="http://europa.eu/rapid/pressReleasesAction.do?reference=IP/12/235&amp;format=HTML&amp;aged=0&amp;language=FR&amp;guiLanguage=en">presented</a>  a proposal for new rules to reinforce the fight against organised  crime, which notably include simplified procedures for the confiscation  and freezing of assets linked to criminal activities in member states.  If the proposal is approved, assets belonging to criminals could be  frozen before they are tried and national authorities will be able to  investigate assets belonging to criminals who are already serving  sentences in prison. Finally, national authorities will have the right  to take charge of assets belonging to criminals who are deceased, on the  run or infirm. </p>
<p>Although it welcomes the proposal presented by Home Affairs Commissioner, C&eacute;cilia Malmstr&ouml;m, <a href="http://www.dn.se/ledare/huvudledare/malmstroms-svara-balans" target="_self"><em>Dagens Nyheter</em></a><a href="http://www.dn.se/ledare/huvudledare/malmstroms-svara-balans" target="_self"> warns </a>that there is a risk that it will undermine individual rights &ndash; </p>
<blockquote><p>If  authorities believe that a person has transferred money to his or her  spouse or children, it will be possible to freeze the assets of the  relatives concerned. What exactly the proposal intends in such cases is  not clear and there is a risk that it could be used against innocent  people. [...] Errors will certainly occur in member states. And who will  defend the rights of those affected?</p>

<item><title>Spain | End of the road for Judge Garzón</title><link>http://www.presseurop.eu/en/content/press-review/1497951-end-road-judge-garzon</link><description><![CDATA[<p>The former star judge was convicted of ordering illegal wiretaps as part of the investigation into the &ldquo;G&uuml;rtel&rdquo; corruption case implicating officials of the Popular Party (PP, in the government) in the Valencia region. The <a target="_self" href="http://www.elpais.com/elpaismedia/ultimahora/media/201202/09/espana/20120209elpepunac_1_Pes_PDF.pdf">conviction</a>, in fact, ends the career of the man who had become famous for arresting the former Chilean dictator Augusto Pinochet.</p>
<p>The conviction also divides the Spanish press.</p><div class="extract"><div class="intror"><p>&ldquo;The Supreme Court finishes with Garz&oacute;n,&rdquo; leads the centre-left newspaper <em>El Pa&iacute;s</em> on its front page. <a target="_self" href="http://elpais.com/elpais/2012/02/09/opinion/1328816501_098588.html">Challenging the decision</a>, the paper writes that its purpose was to</p></div><img src="http://www.presseurop.eu/files/120210elpais_0.jpg" alt="" class="iquote" /><p class="quote">neutralise Judge Garzón. [The decision] involves the expulsion from the judiciary of a judge who, whatever the opinion one may have of him, has rendered important services to society in the fight against terrorism, drug trafficking and organised crime, and one who has played a remarkable role in applying universal justice to the defence of human rights violated by dictatorships.</p></div><div class="extract"><div class="intror"><p>For its part, <a target="_self" href="http://www.elmundo.es/"><em>El &nbsp;Mundo</em></a> points out the unanimity of the Supreme Court judges&rsquo; decision, which in its view is &ldquo;very important, because it confirms that there were no ideological divides, but a shared legal criterion, which is reflected in the decision.&rdquo; The conservative daily goes on to criticise Garz&oacute;n for publishing a <a target="_self" href="http://politica.elpais.com/politica/2012/02/09/actualidad/1328816348_065398.html">statement</a> in which he called the decision &ldquo;unjust and predetermined&ldquo;:</p></div><img src="http://www.presseurop.eu/files/120210elmundo_0.jpg" alt="" class="iquote" /><p class="quote">At the height of paranoia, he argues that the Court&#039;s decision "eliminates all possibility of investigating corruption," as if the only way to do so would be by infringing constitutional guarantees. The statement exposes the megalomania of this man, who believes himself to be the victim of a universal conspiracy and permits himself the luxury of despising and insulting the Supreme Court.</p></div><div class="extract"><div class="intror"><p>The opinion is shared by another conservative daily, <em>ABC</em>: &nbsp;</p></div><img src="http://www.presseurop.eu/files/120210abc_0.jpg" alt="" class="iquote" /><p class="quote">Garzón has paid for his excesses: he has been his own victim. Believing that the end justified the means, he violated a sacred rule of the right of law, turning the investigation into an inquisitorial procedure. [...] It is now the turn of the Strasbourg Court, as he will now allow himself to exploit the international reputation that he has built so assiduously, more by means of spectacle than by his work as a judge [referring to a possible appeal to the European Court of Human Rights, to which Garzón may apply as a last resort].</p></div><div class="extract"><div class="intror"><p><em>P&uacute;blico</em>, finally, <a target="_self" href="http://www.publico.es/espana/421280/la-izquierda-condena-un-fallo-que-secunda-la-derecha">concludes</a> on its front page that Garz&oacute;n has been &ldquo;executed&rdquo;. Austria considers that the European arrest warrant issued by Lithuania last October is not sufficiently specific. Golovatov is seen by some as responsible for the January 13, 1991 attack on Lithuania&rsquo;s television tower by special forces during the country&rsquo;s struggle for independence from Soviet control. The attack left 14 dead and thousands of wounded. Vilnius has recalled its ambassador from Austria and the Foreign Affairs Ministry was ordered to inform its European collegues of &ldquo;this unprecedented decision,&rdquo; reveals <em>Vilniaus diena</em>. In a declaration picked up by the paper, Lithuanian MPs note that &ldquo;releasing a person capable of having committed acts of war is an affront to the fundamental values of the European Union&rdquo;. <item><title>Netherlands | Dutch state liable for Srebrenica deaths</title><link>http://www.presseurop.eu/en/content/news-brief/759871-dutch-state-liable-srebrenica-deaths</link><description><![CDATA[<p>&ldquo;The Court [of Appeal of The Hague] has handed down a historic decision&rdquo; and has left &ldquo;the state in disarray&rdquo; by finding it responsible for the deaths of three Bosnian men during the Srebrenica massacre in 1995, <a target="_self" href="http://www.trouw.nl/tr/nl/4492/Nederland/article/detail/2461966/2011/07/05/Uitspraak-hof-hoopgevend-voor-Moeders-Srebrenica.dhtml">leads <em>Trouw</em></a>. From 1992 to 1995 Dutch peacekeepers (Dutchbat) were responsible under a UN mandate for the security of the Srebrenica enclave in Bosnia-Herzegovina, which was overrun on July 11, 1995 by Serbian troops commanded by Ratko Mladic. These troops then deported and massacred an estimated 7,000 to 8,000 Muslim men. The Dutch peacekeepers had refused to shelter the three men, who were familiar with the Dutch base. According to the court in The Hague, the Dutch &ldquo;were aware&rdquo; that &ldquo;the fate of these three Muslims might turn out very badly.&rdquo;</p>
<p>In its ruling, the court in The Hague stated that the sentence could not automatically be applied to other lawsuits pending against the Dutch state in the Srebrenica massacre, such as the proceedings brought by the 6000 &ldquo;<a href="http://www.trouw.nl/tr/nl/4492/Nederland/article/detail/2461966/2011/07/05/Uitspraak-hof-hoopgevend-voor-Moeders-Srebrenica.dhtml">Mothers of Srebrenica&rdquo;.</a> According to the Amsterdam daily, the government, traumatised by the matter, has remained &ldquo;remarkably silent&rdquo; following the ruling. &ldquo;Up until yesterday, the legacy of Srebrenica had focused on the former commander of the Bosnian-Serb army, Ratko Mladic, who is defending himself before the International Criminal Tribunal for the Former Yugoslavia&rdquo;, also located in The Hague.</p> (News in brief)]]></description><pubDate>Wed, 06 Jul 2011 13:34:42 +0100</pubDate><guid>759871</guid></item>

Dominique Strauss-Kahn, the former head of the IMF, was freed  on July 1 after doubts came to light over the testimony of the woman  who accused him of sexual assault in New York. He is now at the centre  of renewed political speculation in France. Even though charges against  Strauss-Kahn have not been dismissed, this development &quot;is another upset  for the Socialist Party primary&quot;, as the deadline for nominations to  choose a presidential candidate for 2012 is July 13. There's been much  talk of Strauss-Kahn running if he is found innocent, but for now, says Lib&eacute;ration, &quot;his team doesn't even want to think about it. They say that judicial procedure must be followed 'all the way'&quot;.</p>
<p>While they wait, French commentators are focusing their attention on the American judicial system. <em><a target="_self" href="http://www.lemonde.fr/dsk/article/2011/07/02/editorial-du-monde-de-new-york-a-paris-eloge-de-la-lenteur_1543936_1522571.html">Le Monde</a></em><a target="_self" href="http://www.lemonde.fr/dsk/article/2011/07/02/editorial-du-monde-de-new-york-a-paris-eloge-de-la-lenteur_1543936_1522571.html">  castigates</a> a &quot;shocking&quot; system in which &quot;the prosecutor is elected, and  gambles his re-election on results&quot;, criticising the way that &quot;the  American media-justice machine has run away with itself, at a time when  it most needed to prove its slowness and prudence&quot;. By contrast, <a target="_self" href="http://www.liberation.fr/politiques/01012346957-faillible"><em>Lib&eacute;ration</em></a><a target="_self" href="http://www.liberation.fr/politiques/01012346957-faillible">  praises</a> the speed of the American system: &quot;Once part of the accusation  had collapsed, the US courts drew their conclusions with astonishing and  admirable swiftness. According to the daily <a href="http://www.nezavisne.com/novosti/bih/Mladicu-u-Sheveningenu-urucena-optuznica-91785.html" target="_self">based in the Bosnia-Herzegovina Serbian entity, Republika Srpska</a>, Mladić will now face charges of war crimes, crimes against humanity and genocide in the International Criminal Tribunal for the Former Yugoslavia (ICTY) in The Hague. &quot;In deciding to authorise the transfer, Serbia has fulfilled its international and moral obligations. This is a message of reconciliation for the region,&quot; points out Snezana Malovic, the Serbian Minister for Justice, quoted by the newspaper. Close to 10,000 people demonstrated their support for Mladić in the streets of Banja Luka, the capital of Republika Srpska. Events took a rapid turn, following the 31 May rejection of an appeal filed with the High Court in Belgrade. Before being transferred to The Hague, the former military leader was allowed to visit his daughter's grave in a Belgrade cemetery. On May 4, the judges terminated &ldquo;by a landmark <a target="_self" href="http://www.bundesverfassungsgericht.de/entscheidungen/rs20110504_2bvr236509.html">decision</a>&quot; the doctrine of &quot;confinement &ndash; and for ever&quot; of prisoners considered dangerous even after they have served their sentences. This doctrine, in force for ten years, has brought a lot of criticism down on Germany from the European Court of Human Rights. The Constitutional Court has now formulated a new approach to detention, one which obliges the state to take all possible measures from the commencement of detention to reintegrate inmates into society (taking into account vocational training, family contacts, psycho-social therapy). &ldquo;One rarely meets with such a <a target="_self" href="http://www.bundesverfassungsgericht.de/entscheidungen/rs20110504_2bvr236509.html">detailed decision from Karlsruhe</a> [seat of the Constitutional Court], with such sharp suspicion of law-makers, with such precise balancing between freedom and security,&rdquo; writes the paper. In its <a href="http://curia.europa.eu/jcms/upload/docs/application/pdf/2011-04/cp110040en.pdf">judgement</a> on an appeal filed by Algerian Hassan El Dridi, the court ruled that a law introduced by the Italian government in 2009, which allows illegal immigrants to be sentenced to up to four years in prison if they refuse to leave the country, does not comply with European legislation. From now on, all new legislation will have to be accompanied by a study  to evaluate its impact on fundamental rights as stipulated by the <a href="http://www.echr.coe.int/NR/rdonlyres/D5CC24A7-DC13-4318-B457-5C9014916D7A/0/ENG_CONV.pdf" target="_blank"> European Convention on Human Rights</a>. Some lawyers, however, believe such video trials may violate the defendant&rsquo;s right to legal representation. &ldquo;A football stadium is a place for sports, the meting out of justice should be reserved to courts&rdquo;, an unnamed attorney told the Warsaw daily.</p>

The case against Amanda Knox, the American student convicted of the killing of her English flatmate <a href="http://www.guardian.co.uk/world/meredithkercher">Meredith Kercher</a> in the Italian city of Perugia, divides opinion in the countries concerned. Writing in the <em>Guardian</em>, US crime writer Douglas Preston is in no doubt &ndash; she is the latest victim of Giuliano Mignini, a controversial prosecutor already under investigation for suspected abuses during his handling of the Florence serial killer affair in the 80&rsquo;s. After a hurried declaration that Knox and her boyfriend were the murderers, evidence emerged that pointed elsewhere. &ldquo;Suddenly, it appeared that the authorities might have made a terrible mistake&rdquo;, writes Preston in the Guardian. But Mignini went his way. As an insider told Preston, &ldquo;This verdict has nothing to do with the actual evidence. [&hellip;] With the conviction, everyone has &lsquo;saved face&rsquo;&rdquo;.</p>
<p>To appease American opinion, Knox will probably be freed following an appeal, although she&rsquo;ll have to spend another two years in jail. &ldquo;But that&rsquo;s a small matter compared to the career of so many important people,&rdquo; writes Preston. Meanwhile, US and British coverage of the case has caused outrage, in Italy, considered as meddling and disrespectful of Italian institutions. According to writer Alexander Stille, <a href="http://alexander%20stille%20in%20la%20republicca%20http/::ricerca.repubblica.it:repubblica:archivio:repubblica:2009:12:08:perche-amanda-diventa-eroina-america.html">writing in <em>La Repubblica</em></a>, &ldquo;nationality and points of view count&rdquo; &ndash; the English want a scapegoat for the killing of a compatriot, and Amanda Knox, pictured as &ldquo;a man eating, drug abusing she-devil&rdquo; is &ldquo;perfect tabloid material&rdquo;. For Americans, on the other hand, the baby-faced Amanda, an American innocent in corrupt Old Europe &ldquo;is an easy character to identify with&rdquo;. There would be no such upsurge of feeling for her, however, if the case against her was strong, Stille argues. &ldquo;In the US, guilt must established &lsquo;beyond any reasonable doubt&rsquo;, and in this case there is quite a lot to doubt. On 1st September, 2004, dozens of Chechen and Ingush terrorists took 1,128 children and their teachers hostage in a school in Beslan, North Ossetia. Two days later, Russian security forces attacked the buildings with tanks and flame throwers. 330 people including 186 children died in the series of explosions that followed, points out the German daily. According to one of the managers of the association &quot;Voice of Beslan,&quot;&quot;the whole town has been depressed&quot; ever since the tragedy, which left survivors handicapped or traumatized. Vladimir Putin met with local people shortly after the hostage taking, &quot;but nothing has changed since then.&quot; 200 complaints filed on behalf of victims and their families are now awaiting processing by the <a href="http://www.echr.coe.int/ECHR/homepage_en" target="_blank">European Court of Human Rights</a> in Strasbourg, because the residents of Beslan have no confidence in the Russian justice system. Only one of the terrorists has been sentenced.
